Terms of Service

Effective August 30, 2026. Please read these terms before using the Hearem mobile app and website. By accessing or using the service, you agree to follow these terms.

1. Acceptance of Terms

If you do not agree with any part of these terms, you should stop using Hearem.

We may update these terms as the product, legal requirements, or service operations change.

2. Use of Service

Hearem grants you a limited, non-exclusive, non-transferable license to use the service for personal and lawful purposes.

Unless separately authorized, you may not copy, sell, resell, reverse engineer, or misuse the service, interface, model calls, or related functionality.

3. User Content and Responsibility

You retain lawful rights to the text, web pages, images, documents, audio samples, and generated output you provide or create.

You must ensure that imported, generated, and shared content does not infringe copyright, trademark, privacy, publicity, voice, or other legal rights.

If source material involves a voice performer, sound recording, game or film character, or similar protected material, you must obtain every permission needed for the intended use. Permission from one rights holder does not automatically grant permission from the voice owner, performer, recording owner, character owner, or other rights holder.

OCR, summaries, translations, and speech generation may contain errors. You should rely on the original source and your own judgment.

4. Voice Cloning Rules

You may clone only your own voice or a voice for which you have valid permission from every rights holder whose permission is required.

The permission must specifically cover using artificial intelligence, voice synthesis, or similar technology to clone or model the voice and generate derivative audio. It must also cover the intended commercial or non-commercial use, distribution, and duration.

General permission for derivative works, fan works, non-commercial use, in-game use, recorded use, or another broad purpose does not automatically authorize AI voice cloning.

You should keep necessary proof while the permission remains relevant. If we receive a credible rights complaint, we may ask for enough information to verify the scope of permission. Do not submit unrelated personal information or audio.

You may not clone public figures, celebrities, coworkers, friends, family members, or any other person for impersonation, fraud, harassment, deception, or harm.

You may not create deepfakes, false endorsements, misleading audio or video, unlawful promotional content, scams, or content that violates personal rights.

If permission is withdrawn, expires, or turns out not to cover AI voice cloning, you must immediately stop using the related voice in the app and contact support to request deletion of third-party data.

If you publish or distribute synthetic audio, you must follow applicable laws and platform rules for labeling AI-generated content, disclosing its source, and avoiding deception.

If abuse, rights complaints, or legal risk is identified, we may restrict, remove, or disable related cloned voices and features.

5. Prohibited Uses

You may not use Hearem in a way that violates applicable laws or regulations.

You may not create, distribute, or assist with harassment, hate, fraud, explicit content, infringement, threats, deception, or other harmful material.

You may not bypass quotas, abuse APIs, interfere with service operations, scrape systems, defeat security measures, or consume resources abnormally.

6. Intellectual Property

The Hearem app, website, interface, brand, features, code, and original content belong to the developer or relevant rights holders.

Your uploaded source content remains yours or the original owner's. You grant Hearem the permissions necessary to process it for the features you request.

7. Subscriptions, Purchases, and Quotas

Subscriptions, one-time purchases, refunds, and cancellations are usually handled by the Apple App Store and subject to Apple policies.

Different features may use different allowances, such as standard characters, premium voice characters, voice cloning, or extra character packs.

Check the app for current balances, subscription status, and available features.

8. Enforcement and Termination

To protect the service and the rights of others, we may investigate misuse, respond to rights complaints, restrict violating features, or terminate related access.

After a credible voice-rights complaint, notice of withdrawn permission, or urgent safety report, we may first disable the related voice and block new synthesis while we verify permission and process deletion.

Prompt self-reporting, stopping use, and cooperating with deletion may be considered in enforcement, but do not create permanent or unconditional immunity. Serious, repeated, or unremedied violations may lead to feature restrictions, account suspension, or termination.

Where required by law or necessary for safety, we may cooperate with rights holders, platforms, or law enforcement.

9. Disclaimers and Limitations

Hearem is provided as is. AI voices, OCR, summaries, translation, web extraction, and document processing may be inaccurate, unavailable, or inconsistent.

To the extent permitted by law, the developer is not responsible for user misuse, third-party service failures, content infringement, unauthorized cloning, or losses caused by generated content.

10. Reporting and Contact

If you believe Hearem is being used to violate your voice, copyright, privacy, or other rights, contact support@sharcotech.org with relevant details and evidence.

When reporting or requesting deletion of a cloned voice, provide the relevant account identifier, voice name, disputed right, and action requested where possible. Unless necessary for verification, do not resend the disputed audio by email.
